This regulation (hereinafter referred to as "Regulation") defines the rules and conditions for using the online store My Rocky Dust - naturally white and healthy teeth, operating at the address www https://myrockydust.com. The owner of the Store is Przemysław Radosz, a business operator conducting business under the name TRUE NATURE Przemysław Radosz, with registered office at: MIKOŁOWSKA 9, 41-400 MYSŁOWICE, registered in the Central Register and Information on Economic Activity, NIP: 2220759248 (hereinafter "Seller"). To use the Store, the following are necessary: a computer or another device with an internet browser; internet access; an active email address. Personal data
The Seller is the Administrator of customers' personal data. All information on the processing of customers' personal data, as well as other persons using the Store's website, can be found in the Privacy Policy. Conclusion of a sales contract, customer account
The Store enables the purchase of goods (hereinafter "Goods") displayed on the Store's website in two modes: without registration; by creating an account in the Store. In both cases, to place an order, the customer must select the Goods in the Store, add them to the "Cart" with the appropriate button, and continue the order process by selecting the appropriate options (delivery and payment method). Information about products in the Store, i.e., descriptions and prices, constitutes an invitation to conclude a sales contract within the meaning of Art. 71 of the Civil Code, in accordance with the terms of the Regulations. Placing an order requires filling out all the required data in the order form necessary to execute the contract and optionally (at the customer's request) also the data for generating a VAT invoice. If the customer decides to create an account in the Store ("Account"), registration is one-time, and the email address and password chosen by the customer are used for subsequent login. Details of the digital service of maintaining the Account provided by the Seller are available below in the Account Regulations. The Store allows logging into the Account also through social media and/or a user account in the Google system. After logging into the Account, the customer has access to the history of their orders, and for subsequent orders, they do not need to re-enter their personal data in the order form. The customer may resign from having an account at any time without incurring any costs. To do so, they should send their resignation to the email address: shop@myrockydust.com. Approval of the order by the customer by clicking the "Buy and Pay" button (or similar) means: submitting an offer to purchase Goods to the Seller according to the options selected in the order and in accordance with these Regulations, acceptance of the obligation to pay the price of the Goods and the costs of their delivery. The sales contract ("Agreement") is concluded at the moment the Seller accepts the order for execution (acceptance of the customer's offer), which the Seller confirms by email with an order confirmation. If it is not possible to fulfill the order for Goods (in whole or in part), the Seller will inform the customer - in such a case, no Agreement is concluded. The Seller will also inform the customer about other possible ways to fulfill the order, e.g., partial fulfillment of the order or waiting for the Seller to replenish the stock. If the order has already been paid by the customer and cannot be fulfilled, the Seller will promptly refund the payments made by the customer (according to the scope of the order cancellation). The Seller provides the customer with confirmation of the conclusion of the Agreement on a durable medium no later than at the time of delivery of the Goods. The Store is not responsible for non-delivery of an order or delay in its delivery resulting from the customer providing an incomplete/incorrect delivery address or failure to provide other data necessary for order fulfillment. The Seller reserves the right to suspend the fulfillment of an order if the customer has provided untrue data or if these data raise reasonable doubts as to their correctness. In such a case, if possible, the Seller will attempt to contact the customer to verify the accuracy of the provided data. Prices and payment methods
Prices of Goods are quoted in Polish zloty (PLN) and gross amounts, i.e., including VAT. The cost of delivering Goods is provided separately in the Store's cart, depending on the delivery method chosen by the customer. Available payment methods are described on the Store's website in the "Payment Methods" tab and are presented to the customer during the order placement process (in the cart). The Store offers the following payment methods: traditional bank transfer to the Seller's account fast electronic transfer / BLIK / payment via a "virtual wallet" - through the payment platform: Shoper Payments (Autopay) PayPal credit card payment: Visa, Visa Electron, MasterCard, MasterCard Electronic deferred payment - through the operator indicated during the order placement. If the customer has chosen payment by ordinary bank transfer, payment for the order must be made within 2 days from its submission. In the absence of payment within the above-mentioned period, the Agreement is considered not concluded. The preceding sentence does not apply in situations where the Seller offers customers deferred payment/payment in installments through an external partner. In the case of choosing payment through Shoper Payments, Autopay S.A. is the entity providing online payment services for fast transfers and credit card payments. Delivery of goods
Delivery of Goods is carried out according to the customer's choice: via courier company to InPost parcel lockers Except for Goods picked up by the customer personally, the order is considered fulfilled upon dispatch of the shipment to the customer (entrusting the shipment to the carrier engaged in transport). The exact actual delivery date of the shipment is determined by the carrier. Goods are dispatched by the Seller within 2 business days, unless a different deadline is clearly stated in the product description during the customer's order placement. Detailed delivery times are provided on the Store's website in the "Order Fulfillment Time" tab. The Seller normally handles orders within the territory of the Republic of Poland at the costs indicated on the Store's website in the "Time and Delivery Costs" tab. Shipping abroad is possible at the costs indicated on the Store's website or costs individually agreed with the customer. Withdrawal from the agreement
A customer who is a consumer or a privileged entrepreneur as referred to in Art. 7aa of the Consumer Rights Act ("Privileged Entrepreneur") has the statutory right to withdraw from the sales contract for Goods within 14 days from their receipt, without giving any reason, subject to exceptions as mentioned below. To meet the withdrawal deadline from the contract, it is sufficient for the customer to send a statement: electronically to the address: shop@myrockydust.com or in writing to the address: 41-400 Mysłowice, Mikołowska 9. The declaration of withdrawal from the contract can be submitted using the form available here, although the use of the form is not mandatory. The Seller will immediately send the customer an email confirmation of receipt of the statement of withdrawal from the contract. Subsequently, within the next 14 days, the customer should return the returned Goods at their own cost to the postal address 41-400 Mysłowice, ul. Mikołowska 9. The Seller will promptly, no later than within 14 days of receiving the statement of withdrawal from the contract, refund to the customer: the price of the Goods; the cost of the initial delivery of the Goods to the customer by the cheapest regular delivery method offered in the Store. The Seller may refrain from refunding payments until receiving the Goods back or until the customer provides proof of sending the Goods back. The refund will be made using the same payment methods used by the customer in the initial transaction unless the customer expressly agrees to another solution. The customer is liable for any diminished value of the returned Goods resulting from their handling in a manner other than necessary to establish the nature, characteristics, and functioning of the Goods. Exceptions from the right to withdraw from the sales contract for Goods
The right to withdraw from the contract does not apply to contracts for the supply of Goods: that are not prefabricated and are made according to the consumer's / Privileged Entrepreneur's specifications or to satisfy their individualized needs (personalized goods); that are liable to deteriorate rapidly or have a short shelf life (perishable goods); delivered in sealed packaging that has been opened after delivery and cannot be returned due to health protection or hygiene reasons (goods packaged for hygiene reasons); of audio or visual recordings or computer programs delivered on a tangible medium (e.g., CD) in sealed packaging if the packaging has been opened after delivery; that, due to their nature, are inseparably mixed with other items after delivery (e.g., building materials if used); of newspapers, periodicals, or magazines, except for subscription agreements (printed press); whose price depends on fluctuations in the financial market over which the Seller has no control and which may occur before the withdrawal deadline. of alcoholic beverages, the price of which was agreed upon the conclusion of the sales contract, and whose delivery can only
